The Kano State Government has decided to withdraw its lawsuit filed in the Federal High Court of Kano, which aimed to prevent the Economic and Financial Crimes Commission (EFCC) from investigating former governor Abdullahi Ganduje.
A letter dated July 4, 2023, and signed by Haruna Isa Dederi, the Kano Attorney General and Commissioner for Justice, was sent to Sanusi Musa, a Senior Advocate of Nigeria (SAN), to convey the withdrawal notice. The letter notified Musa that the Kano State Government and the Attorney General of Kano State wished to revoke the earlier instructions given to him regarding the case with the reference number FHC/KN/71/2023, involving the Attorney General of Kano State and the EFCC.
According to the letter, Musa and his team were instructed not to proceed with any actions related to the case, including appearing in court or submitting any documents. The Kano State Government had previously issued an instrument through the Ministry of Justice to restrain the EFCC from investigating the contentious dollar video associated with the former governor.
With the withdrawal of the suit, the Kano State Government has effectively halted its legal efforts to prevent the EFCC from investigating the activities of Abdullahi Ganduje during his tenure as governor. The reasons behind this decision remain undisclosed, but it signifies a shift in the government’s stance on the matter.
The withdrawal of the lawsuit could potentially allow the EFCC to proceed with its investigation, focusing on the alleged financial misconduct and corruption involving the former governor. This development may lead to further scrutiny and potential legal consequences for Abdullahi Ganduje, depending on the findings and actions taken by the EFCC.
It is noteworthy that the withdrawal of the suit does not imply guilt or exoneration for Abdullahi Ganduje. Rather, it signals a change in the legal strategy employed by the Kano State Government in relation to the investigation, allowing the EFCC to continue its efforts unimpeded. The case will now likely proceed without the legal obstacle posed by the Kano State Government’s lawsuit, and further developments in the investigation are awaited.
