Charly Boy Threatens Legal Action Against Premier Records for Breach of Contract.
Veteran entertainer Charly Boy has threatened to sue Premier Records Limited for allegedly violating the terms of a musical contract signed 35 years ago.
In a letter to the record label dated June 19, 2023, Charly Boy’s lawyer, Rockson Igelige, said that the contract had expired, but Premier Records was still breaching Charly Boy’s copyrights to the musical works.
Igelige demanded that Premier Records hand over Charly Boy’s master tapes, artworks, promo collateral, and other relevant and confidential information within 30 days. He also demanded that the record label pay Charly Boy’s outstanding royalties.
The albums affected by the alleged breach include “Big Bottom,” “Aids,” “Sexy Lady,” “Mama,” and “Nwata Miss” (recorded in 1990); “U-Turn” (with songs including “Akula,” “Sheri,” “Comfort,” “Civilian Barrack,” and “Akula (Instrumental)”); and “Reality” (with songs including “Monkey,” “Family Support,” “No.6 Man,” “Give Mv Life,” “Lagos Life,” and “Baby Come Back“).
Igelige argued that the terms of the contracts entered with Premier Records as Polydor Record in 1988, Polygram Records Limited in 1990, and currently Premier Records Limited had ended by expiration of time. He said that Premier Records was in breach of the contracts because it had not met the condition precedent and consideration for the contracts.
Igelige warned that further breach of the contracts after the receipt of the letter would attract legal action. He said that Charly Boy hoped and trusted that Premier Records would comply with his “modest demands.”
This is a serious development for Charly Boy, who has been a major figure in the Nigerian music industry for over 30 years. If Premier Records does not comply with Charly Boy’s demands, it could face legal action.
